DC & Maryland

Divorce in the District and in Maryland

Filing requirements differ between the two jurisdictions. A few key differences:

District of Columbia

  • Divorce is no-fault. Grounds generally require a period of mutual and voluntary separation or a longer period of separation.
  • At least one spouse must have lived in DC for six months before filing.
  • Marital property is divided equitably, which means fairly, not necessarily equally.
  • Cases are heard in the Family Court of the DC Superior Court.

Maryland

  • Since October 2023, grounds include six-month separation, irreconcilable differences, and mutual consent.
  • Residency requirements apply, generally six months when the grounds arose outside Maryland.
  • Marital property is divided equitably, often through a monetary award.
  • Cases are heard in the circuit court of the county where either spouse lives.
